Commissioners met with Jeff Campbell, Road and Bridge Supervisor. They discussed RFQ for BRO bridges, an ARPA application for county bridges and pouring the walls for the salt bin at the Road and Bridge barn.

Commissioners had a conference call with Jim Noland of Security Bank, Attorney Padraic Cockran, Charlie Zitnik and Jonathan Benson of DA Davidson, Megan of Gillmore Bell and Julie Marks, Greg Pitchford and Cary Sayre of Allstate. They discussed the financing for Little Otter Creek and ballot language for ½ cent sales tax collected from Caldwell County citizens.

Commissioner Motsinger called the meeting to order in the commissioner’s room of the Caldwell County Courthouse with Deputy Clerk Dori Creekmore. County Clerk Christine Owen participated by phone. Roll call: Bud Motsinger; present, Rex Hibler; present, Jonathan Abbott; was absent. The meeting was opened with the Pledge of Allegiance. Commissioners met with Jeff Campbell, Road and Bridge supervisor. They are working on a FEMA project on Millcreek Road. The crew will be off through the end of the year unless we have snow to plow.
The truck that was ordered early this year could possibly be here before the end of the year and is on the 2022 budget.
Commissioner Abbott arrived at 8:45 AM.
Commissioners met with Emergency Management Director Mark Merrill to discuss a MODOT grant to cover CERT Team equipment. Also submitted a grant for 2 new sirens for the county. They discussed the generator that was paid for by a grant and will be at the courthouse. They have plans for a building at the north entrance of the courthouse to store it in.
Commissioners met with Caleb Bardwell and Pat Fee to discuss clearing brush for the fencing between Caleb Bardwell property and Little Otter Creek property. They reviewed bids to clear the brush in order to build fence later. Commissioner Abbott moved to accept the bid from Red Rock for $8,000 with a 50/50 cost share with landowner Caleb Bardwell. Commission Motsinger seconded the motion. A roll call vote was taken as follows: Bud Motsinger voted yea; Jonathan Abbott voted yea; Rex Hibler voted yea. A separate bid for the county property to layover all trees, burn and bury the stumps. Commissioner Abbott moved to accept the bid from Red Rock for $4,500 which is county only. Commission Motsinger seconded the motion. A roll call vote was taken as follows: Bud Motsinger voted yea; Jonathan Abbott voted yea; Rex Hibler voted yea.
Commissioners participated in a zoom call with Allstate Consultants to discuss Little Otter Creek construction progress. Commissioners reviewed change order no. 4 for Phillips Hardy Inc. This will adjust contract price to include additional unclassified excavation due to laying back the west abutment to reduce the quantity of surface grout required and increase bid item 7.00, unclassified excavation, by 9434 C.Y. for an additional $155,661 total dollar amount with no change to contract time. The new contract amount is $14,811,108.25 for the project. Commissioner Motsinger moved to approve change order 4 and will sign on behalf of the county. Seconded by Commissioner Abbott. A roll call vote was taken as follows: Bud Motsinger voted yea; Jonathan Abbott voted yea; Rex Hibler voted yea. Change order no. 4 was signed. Commissioners reviewed and approved payment app #7 for Phillips Hardy Inc. for $337,686.31 and it was sent to NRCS for pre-approval before the payment is made.
Commissioners met with Prosecuting Attorney Brady Kopek and from Invenergy (formally Grain Belt) were: Jason Brown, Brad Pnazek, Seth Wright & Mike Blazer. Commissioner Abbott moved to go into closed session per RSMO 610.026 (1) to discuss legal matters. Seconded by Commissioner Hibler. Commissioners met with Terry Rumery of Rumery & Associates to discuss economic development for the county.
Commissioners met with Judge Ryan Horsman, Circuit Clerk Carrie Miller and Seth Oaks to discuss the annual budget.
Commissioners met with Larry Chipman to discuss ARPA applications. The ARPA board met on December 15, 2022 to review applications and recommended the commissioners approval of 3 applications at this time. Commissioner Abbott moved to approve application #9 supplemental for $14,107.30; #38 for $115,000 and #39 for $75,674.43. Commissioner Hibler seconded. A roll call vote was taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea. The next meeting of the ARPA board will be January 24, 2023.
Commissioners reviewed the Compliance Certification issued by the U.S. Army Corps of Engineers relating to the permit for the mitigation credits on the Little Otter Creek Reservoir Project. Commissioner Hibler moved to approve Order No. 2022-12-19, an Order Approving the Compliance Certification issued by the U.S. Army Corps of Engineers relating to the nationwide permit NWP 14 and the Little Otter Creek Reservoir Project, authorizing execution of the same, and ratifying the past actions of the officials of the County of Caldwell taken before the adoption of this Order. Commissioner Abbott seconded and a roll call vote was taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.
Commissioner Hibler moved to approve as of 12:01 AM on 01-01-2023 that Bud Motsinger and Christine Owen will be replaced with Dale Akey and Jamy Aubrey as signatory for Caldwell County for all necessary accounts. Commissioner Abbott seconded the motion, and a roll call vote was taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.
Commissioner Hibler moved to change the official meeting days of the Caldwell County Commission effective with the first meeting of 01-03-2023 to Tuesdays and a bi-weekly Thursday meeting for payroll instead of the current Monday meeting day and bi-weekly Friday meeting for payroll. Commissioner Abbott seconded the motion, and a roll call vote was taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.
Commissioner Hibler moved to allow Jamesport fencing to supply and erect fence at $2.60 per foot for a 5-strand barbed wire fence between the county property at Little Otter Creek and the adjoining property owner Caleb Bardwell with the understanding of a 50/50 cost share. Commissioner Abbott seconded the motion and a roll call vote was taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.
Commissioner Hibler moved to sign an order for sales taxes to be collected on the retail sale of marijuana and to place it on the ballot for the approval of voters on the April 4, 2023 election. Commissioner Abbott seconded the motion and a roll call vote was taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea. The county signed the order to start the process.
